The Government has issued a Decree detailing royalties for works in the fields of cinema, fine arts, photography, performing arts, journalism, and publishing. This is an important legal document aiming to improve the legal framework on intellectual property, protecting the legitimate rights and interests of authors and copyright holders.

Scope of regulation and subjects of application

The Decree specifically regulates the tariff and method of paying royalties when exploiting and using works. The subjects of application include organizations and individuals exploiting and using works, as well as authors, copyright holders, and related rights holders in the aforementioned fields.

Principles of determining royalties

The determination of royalties must ensure a harmony of interests among creators, utilizing organizations, and the accessing public. The royalty rate is determined based on the following factors:

  • Genre, scale, and quality of the exploited work.
  • Form and scope of using the work (in traditional environments or digital environments).
  • Revenue or economic efficiency obtained from the exploitation and use of the work.

Encouraging agreement and transparency

The Decree encourages parties to voluntarily agree on royalty rates in accordance with the provisions of law. In case an agreement cannot be reached, the parties may apply the framework tariff detailed in the appendix issued with this Decree. The application of digital technology in royalty management and payment is also encouraged to ensure openness and transparency.
